Ferge Auctions Terms and Conditions
Buyer, Payment, Tax, Removal, and Auction Policies

General Notice
Please read all terms and conditions carefully before participating in the auction.

Agreement to Terms
By registering as a buyer or Internet buyer, you agree to abide by all terms and conditions outlined in this document. Bids placed at this auction are legally binding contracts. The bidder associated with the bidding number is personally responsible for all bids submitted using that number and is liable for any resulting payments, without protest, setoff, or claim against the auctioneer or Equipmentfacts LLC.
If the highest bid for a lot is submitted using your bidding number, you are responsible for completing the purchase. The highest bidder for each lot will be the purchaser. In the event of a dispute, the auctioneer and Equipmentfacts may settle the dispute as they determine or reoffer the lot for sale.
Failure to make payment will result in your account being blacklisted, preventing you from bidding again at Ferge Auctions and Equipmentfacts.

Payment Terms
Ground bidders must pay on the day of the sale. A 1% buyer’s premium will be applied.
Online bidders must pay by 1:00 PM CST on the first business day, Monday, following the auction, unless other arrangements have been
agreed upon. A 4% buyer’s premium will be applied.
Accepted payment methods include cash, check, credit card, and wire transfer.
Credit card payments are subject to a 4% processing or administrative fee.
Wire transfer fees are the buyer’s responsibility.
A $25-per-day late fee will be added to overdue payments.
If you are unable to meet the payment deadline, contact the auction team as soon as possible.
If you plan to pay at pickup, you must pick up the item and pay by Monday unless other arrangements have been agreed upon.

Taxes and Exemption Certificates
Applicable state sales tax will be charged on all lots. A 9.75% sales tax must be collected unless a valid exemption is presented at checkout.
All tax forms must be submitted before payment, or sales tax will be charged.
Submit copies of your Tennessee Agricultural Exemption, Resale Certificate, and Auto Dealer Certificate to have applicable taxes removed.
Tennessee does not recognize Streamlined Agricultural exemption forms or out-of-state agricultural cards. A Tennessee Agriculture Certificate is required.
For agricultural equipment tax exemption, residents of all states must obtain a Tennessee Agricultural Exemption Card. Farmers outside Tennessee may apply for a Tennessee Agriculture Card.
Out-of-state agricultural exemption cards do not apply.
Any state’s Certificate of Resale will be accepted.
Title vehicles and trailers are tax exempt for out-of-state residents, but buyers must register them and pay taxes in their home state.

Buyer’s Premiums and Fees
A 1% buyer’s premium will be added to the final bid for ground bidders.
A 4% buyer’s premium will be added to the final bid for online bidders.
Online bidding is provided by Equipmentfacts.
Credit card payments are subject to a 4% administrative fee.
Online buyers will pay an Internet purchase fee on the hammer price, meaning the winning bid amount, for all online purchases.

Invoices and Titles
Invoices will be emailed after the auction is over. Wire instructions will be emailed with the invoice.
Invoices and titles must match exactly. Titles will be processed using the name and address provided during registration. If you purchase a titled item, make sure your invoice reflects the information that needs to appear on the title.
All titles will be mailed to the registered address unless other arrangements are requested.

Loading and Removal

Loading times (CST):
Saturday, day of sale: Noon–6:00 PM
Sunday: No loading
Monday–Thursday: 7:30 AM–4:00 PM

Please give the auction team advance notice when you plan to load equipment so they can make sure someone is available. The auction team will help load equipment free of charge.
All items must be removed from the lot by the following Thursday unless other arrangements have been made.
The loader may not be available after Thursday.
A $20 fee will be charged for each day an item remains after the removal deadline unless otherwise agreed. No items will be removed from the sale site without full payment. Ferge Auctions reserves the right to hold items until full payment is verified.
All purchases must be removed from the premises by the deadline. Communication is key; please keep in touch regarding payment and removal.

Sale and Auction Policies
• All sales are final.
• Bids placed at this auction are legally binding contracts.
• All items are sold as-is, where-is, with no express or implied warranty.
• The buyer is responsible for conducting personal inspections before purchase.
• Announcements made on the day of the sale take precedence over all advertising.
• The auctioneer and Equipmentfacts are not liable for losses or damages arising from lots not presented for sale, including bidders’ attendance costs.

Item Descriptions and Condition
Information regarding items, including serial numbers, weights, horsepower, lift capacities, length, height, hour meter readings, and mileages, comes from sources generally deemed reliable but is not guaranteed. Hour meter readings and mileages are unverified. The winning bidder is responsible for verifying all information before purchase.
The auction company, auctioneer, and Equipmentfacts do not guarantee or warrant the authenticity, genuineness, origin, age, condition, quality, or accuracy of any lot or description, whether provided orally, in print, or in a catalog. Lot descriptions may be provided by vendors or other third parties over whom the auctioneer and Equipmentfacts have no control. Statements regarding these matters are opinions only.
All claims against Ferge Auctions, the auctioneer, Equipmentfacts, and their respective employees and agents arising from or related to lot descriptions or representations are waived and released.

Clerk Liability
Clerks are not responsible for written errors, typographical errors, or incorrect bid amounts. Corrections will be made as necessary.

Total Hammer Price Disclaimer
By acknowledging the total as the hammer price, you accept responsibility for providing accurate information. You are liable for any false or misleading statements.
